Chapter 1 -  General provisions

Article 1 - Status

1. Tbilisi Humanitarian Teaching University is a higher educational institution established under the legislation of Georgia, it is a legal entity under private law - a limited liability company, which carries out educational activities in accordance with the mission of Tbilisi Humanitarian Teaching University and this Regulations;

2. Tbilisi Humanitarian Teaching University, in accordance with Article 2(z29) and Article 9 (1)(b) of the Law of Georgia on Higher Education, is a university, which does not carry out doctoral educational programs;

3. A full name of Tbilisi Humanitarian Teaching University is Tbilisi Humanitarian Teaching University LLC, and the brief name is: Tbilisi Humanitarian University, or THU;

4. The legal status of Tbilisi Humanitarian Teaching University, as an entrepreneurial person, shall be defined on the basis of the statute of THU;

5. Tbilisi Humanitarian Teaching University possesses a seal which reflects its name, the letterheads, a stamp and a bank account;

6. Legal address of Tbilisi Humanitarian Teaching University: N10 Building, N3 Sandro Euli Street, Tbilisi 0162, Georgia; actual address (location): N31 Beri Gabriel Salosi Avenue, Tbilisi 0144, Georgia;

7. Tbilisi Humanitarian Teaching University can have branches (representation offices) on the territory of Georgia, which are established in accordance with the legislation of Georgia, which do not represent legal persons, act on behalf of the University, and on the basis of the Regulations approved by the University.

 

Article 2 - Legal grounds of activities

1. Tbilisi Humanitarian Teaching University shall carry out educational activities on the basis of the Constitution of Georgia, international agreements and treaties of Georgia, the Law of Georgia on Higher Education, normative acts of Georgia, and on the basis of the orders of the Minister of Education and Science of Georgia, educational standards, legal acts of the LEPL National Canter for Education Quality Enhancement, this Regulations and the mission defined by the University;

2. In the case of inconsistency between the Regulations and the legislation of Georgia, the legislation of Georgia shall apply; the amendments and addenda to the legislation of Georgia, which do not comply with the articles, paragraphs or sub-paragraphs of this Regulations, shall entail the invalidity of the relevant article, paragraph or sub-paragraph.

 

Article 3 - Aims and objectives

Aims and objectives of the University shall be defined on the basis of the mission approved by the University, and shall comply with the policy defined by the State in the field of education.

 

Article 4 - Subject of activities

1. For ensuring the implementation of aims and objectives defined by the mission of the University, the latter shall carry out the following educational and/or related activities in accordance with the legislation of Georgia:

a) implementation of educational programs for a Master’s degree;

b) implementation of educational programs for a Bachelor’s degree;

c) implementation of a one-level educational programs defined by the Law of Georgia on Higher Education;

d) production of intellectual property products and carrying out publishing activities;

e) collaboration with educational and scientific institutions of Georgia and of foreign countries;

f) providing educational and other related services provided for by the legislation of Georgia.

2. The University shall not carry out doctoral educational programs.


Article 5 - Independence

The University shall be independent in its activities. The independence shall equally apply to academic, creative and publishing activities.

 

Article 6 - Sources of financing and ownership

1. The following shall be the sources of financing of the University:

a) educational scholarships obtained by the students enrolled in the University;

b) other funds received from teaching and educational activities of the University;

c) funds received from publishing activities;

d) founders’ investments;

e) other revenues permitted by the legislation of Georgia.

2. Basic funds on the balance of the University shall be the property of the University. Educational inventory, other logistics; intellectual and other production (work) produced by the University, and other property permitted by legislation.

3. From the revenues received from activities based on this Regulations, and in accordance with the Statute of THU, and for the purposes of the functioning and development of the University, the founders’ (partners’) meeting shall define the annual amount of funds from the revenues of the University, within the framework of which, annual budget of the University, - the teaching and educational institution, shall be defined.



Chapter 2 - Management of the University

Article 7 - University management bodies 

1. University management principles are:

a) publicity and availability of legal acts;

b) academic freedom of academic personnel and students;

c) participation of academic personnel and students in the decision making process;

d) equal treatment despite the ethnic affiliation, sex, social origin, political or religious approach, etc of a person;

e) fairness and transparency of elections, publicity of competitions;

f) entrepreneurial freedom.

2. University management bodies and officials are:

a) founders’(partners’) meeting;

b) representative council (senate);

c) academic council;

d) rector, pro-rector;

e) head of Quality Assurance Service;

f) head of administration (administration service).

3. A member of the founders’ (partners’) meeting shall have the right to be elected in the University management body (in the case of occupying the position of the rector, member of the academic council, representative council (senate), and the positions of the professor or associated professor) or to be recruited for another position defined by the staff list of the University.

 

Article 8 - Authorities of the founders’ (partners’) meeting

1. The founders’ (partners’) meeting shall be authorised to:

a) give approval for the mission of the University, and long-term and single-year action plans for the strategic development;

b) make amendments and addenda to the Statute of the University;

c) approve the budget of the University;   

d) be introduced to accounting documents of the University and other documents related to the activities of the University, conduct annual financial and economic analysis of the activities of the University, and schedule and conduct the audit;

e) obtain information on the activities of the University, approve annual report of the rector on the activities of the University; work out recommendations where required with regard to the improvement of University activities;

2. Special authority of the founders’ (partners’) meeting shall be defined by the statute of THU.

 

Article 9 - Representative council (senate)

1. Representative council (senate) of the University shall be selected by the students and academic personnel separately, from the faculties, and on the basis of representations, in proportion with their number at basic educational units. The number of representative members of the representative council shall be 18 and it is twice more than the number of the members of the academic council.

2. The representative council shall be elected on the basis of universal, direct and equal elections, secret ballot, in accordance with the procedure defined by the Regulations.

3. The term of authority of the representative council comprises 4 years.

4. The students shall comprise one third of the total composition of members in the representative council (6).

5. The representative of the library shall be automatically included in the composition of the representative council.

6. The representative council may include a graduate of the university or a parent, as an interested representative from the public.

7. The grounds for the termination of the status of the representative council of the professor and the student shall be the termination of his/her relevant academic and/or labour relations with the University.

8. In the case of the termination of the authority of the member of the representative council, a new member shall be elected for the remaining term of authority of the representative council.

9. The representatives of the administration and assistance personnel, as well as the members of the academic council cannot be elected as members of the representative council.

10. The representative council shall:

a) approve the proposals prepared by the academic council with regard to making amendments and addenda to the Regulations of the University, and the structure of the University prepared by the academic council;

b) approve the head of the Quality Assurance Office of the University to the position, upon the recommendation of the academic council;

c) approve the head of the Administration (Administrative Office) of the University to the position, upon the recommendation of the academic council, and also approve the annual report submitted by him/her;

d) be authorized, upon the reasonable proposal of the academic council or at its own initiative, to terminate the authority of the head of the Quality Assurance Service, and of the head of the Administration;

e) approve the Internal Regulations and the norms of ethics and disciplinary liability measures of the University;

f) work out the draft budget of the University and submit it to the founders’ (partners’) meeting for approval;

g) approve the procedures for recruiting support staff on the basis of the proposal of the head of Administration, in agreement with the rector, in the case of the application by the head of Administration;

h) elect, with the majority of members on the list, the chairman and the secretary of the representative council, publish agenda, and resolutions taken during the council meeting;

i) approve the Regulations of the Services existing in the University;

j) exercise other powers.

11. The meetings of the representative council shall be held at least twice a year; the meetings of the representative council shall be summoned by the chairman of the Council on its own initiative, based on the application by the academic council or the rector, and on the initiative of one thirds of the total members of the Council;

12. The representative council shall adopt decisions with a majority of its members on the list.

13. The meetings of the representative council shall be organized and presided by the chairman of the council, elected by the representative office from the majority of the members on the list, for no more than the term of office of 4 years of the representative office, and in the case of his/her absence, the chairman of the council shall be elected from the council members during the council meeting, by the majority of the members of the council on the list.

14. Grounds for the termination of the terms of office of the chairman of the representative council shall be:

a) personal application;

b) the judgement of conviction against him/her that has entered into force;

c) death;

d) declaring him/her by a court as a legally incapable person or as a person with limited capabilities;

e) the dismissal from the academic position.

 

Article 10 - Academic council of the University

1. The academic council of the University shall be elected by all members of the academic personnel of the faculty and the representatives of the students’ self-government body on the basis of direct, free and equal elections, secret ballot.

2. The academic council shall be composed of at least 9 members. All four faculties of the University shall be equally represented by 2 representatives; the academic council of the University shall be composed of a University rector, who is also the chairman of the academic council;

3. Only a professor or an associated professor shall be elected as a member of the academic council.

4. The term of election of the member of the academic council shall coincide with the duration of the basic educational level, which shall be 4 years.

5. The academic council shall:

a) work out, agree with the founders’ (partners’) meeting and approve long-term and one-year University development plans;

b) work out proposals for making amendments and addenda to the Regulations of the University and submit it to the representative council for approval;

c) work out University structure and submit it to the representative council for approval;

d) approve educational programs by the recommendation of the faculties, and modify them;

e) facilitate the integration of the higher education in the European space, the collaboration between the higher educational institutions and/or the creation of joint programs;

f) nominate candidates for the head of the Quality Assurance Service and for the head of the Administration, upon the recommendation of the majority of members on the list;

f) submit reasonable proposals for early termination of the term of office of the head of the Quality Assurance Service and the head of the Administration, upon the recommendation of the majority of members on the list;

g) participate in the review of the budget of the University;

h) approve the Regulations of the faculty;

i) approve coefficients for centralized university entrance examinations, in the cases provided for by the legislation of Georgia - for Master’s examinations, as well as the number of students to be enrolled in the faculty, upon the recommendation of the faculty;

j) approve the procedures for obtaining the status of a student, its suspension and termination, mobility, and the procedures for the acknowledgement of education taken during the educational process;

k) approve the procedures for ensuring further education of students in relevant programs in the case of the changing or abolishing the educational program;

l) approve the assessment system of educational program implementation upon the recommendation of the Quality Assurance Service;

m) elect the chairman of the academic council - the rector of the University, by the majority of members on the list, secret ballot, on the basis of free and equal elections;

n) review the matter related to the termination of the term of office of the rector on the grounds of the violation of the legislation of Georgia by the rector, improper fulfilment of the duties of a rector and/or on the grounds of carrying out activities that are not allowed for a rector, at the initiative of the founders’ (partners’) meeting, or on the basis of the prior consent of the meeting; a decision on the termination of the term of office of the rector shall be taken by a secret ballot, by the 2/3 of the total number of members of the academic council; the rector shall not participate in the ballot referred to in this paragraph until the new rector is appointed, and the duties of the rector shall be fulfilled by a pro-rector;

o) exercise other powers granted under the legislation of Georgia and this Regulations.

6. The academic council shall be convened at the initiative of the rector

7. The academic council shall adopt decisions by a majority of its members on the list. It shall be authorized to make a decision if the meeting is attended by at least 2/3 of the total members of the academic council.

8. The decision of the academic council shall enter into force after its signature by the chairman and the secretary elected by the members of the academic council, and after its publishing on the official website of the University.

 

Article 11 - Rector, pro-rector

1. A rector is the highest academic official of the University, the chairman of the academic council and represents the University inside and outside the country, within the academic circles, also before the founders’(partners’) meeting, for which he/she shall be authorized to conclude transactions and agreements in the name of the University. If the conclusion of the transaction and agreement is related to the financial and economic matters, they shall be also signed by the head of the Administration;

2. A rector shall be elected by the academic council of the higher educational institution , on the basis of a secret ballot, by a majority of members on the list, and for the term of four years.

3. The academic council of the University shall publish the announcement on the vacancy of a rector for the registration of candidates one month before the start of the registration of candidates, and shall publish the announcement on the elections on the basis of the principles of transparency, equality and fair competition.

4. Before the election of a rector, during the selection of a candidate, the academic council shall assess the action plan submitted by each candidate.

5. The rector shall appoint from among the persons on the academic positions of a professor or an associate professor, a person to the position of a pro-rector, with his/her term of office; the pro-rector shall be accountable and responsible before the rector;

6. The rector, or in the case of his/her absence, or under his/her instructions, the pro-rector shall:

a) manage and lead the activities of the University in accordance with the legislation of Georgia;

b) represent the University in the state and other agencies, institutions and organizations, also in the students’ associations in accordance with the legislation of Georgia;

c) conduct negotiations, conclude agreements, and sign other documents on behalf of the University; be authorized to manage relationship between the universities directly, or through the pro-rector;

d) control the fulfilment of the Statute, Regulations, Internal Regulations and other legal acts of the University; regulate the legal matters of the University with the help of the pro-rector;

e) control the process of implementation of educational programs;

f) appoint to and release from the positions deans of the faculties elected by the faculty council, define their tasks and duties and obligations in accordance with this Regulations, and control their activities;

g) ensure the provision of staff for the University, approve a staff list of the University, appoint to and dismiss from the position persons in the staff list of the University, invite teachers upon the recommendation of the appropriate dean of the faculty on the basis of hourly compensation, and conclude employment agreements with such teachers;

h) manage and administer the process of the enrolment of students in the University, approve education fees, and issue appropriate acts on the students’ movement;

i) manage University’s property in agreement with the partners’ meeting;

j) based on this Regulations and the Statute of the University, enforce the decisions made by the founders’ (partners’) meeting, representative council and academic council of the University;

k) make decisions on the matters related to the encouragement and disciplinary persecution of employees within the scope of competence defined by the Internal Regulations of the University;

l) approve the Regulations for the use of the library;

m) issue orders;

n) assign separate tasks and official functions to the pro-rector on the basis of the order;

o) exercise other authorities deriving from this Regulations, Statute, which do not contravene the legislation of Georgia.

7. The pro-rector of the University shall be accountable before the founders’ (partners’) meeting, and in certain cases - before the representative council and the academic council.

8. The rector shall be obliged to provide one of the founders (partners), upon request, with information regarding the activities of the University and shall allow their access to the university documentation.

 

Article 12 - University Administration (the administration service)

1. University Administration (the administration service) shall integrate the following fields:

- Chancellery;

- Accounting;

- International relations and foreign students assistance;

- Legal support;

- Management of human resources;

- Material-technical support;

- Safe environment;

- Archive;

- Career development and student support;

- Scientific researches;

2. Departments may be created in the University Administration, where necessary, and on the basis of the decision of the representative council;

3. The Administration shall be headed by the head of the Administration, who is the highest administrative manager of the University in the field of finance, logistics and human resources, which represent the University during the financial and economic relations.

4. The head of the Administration shall be approved by the representative council upon the recommendation of the academic council, on the basis of the secret ballot;

5. The term of authority of the head of Administration comprises 4 years.

6. The head of the Administration shall:

a) manage the University Administration (the administration service);

b) be authorized to determine the procedures for the recruitment of assisting personnel in the office, the amount and conditions of their remuneration and shall submit it to the representative council for approval;

c) participate in the drafting of the University budget; control the process of the fulfilment of the University budget;

d) prepare annual reports of completed work and submit them to the representative council for approval;

e) be responsible for the lawfulness and effectiveness of financial and economic activities of the University;

f) be authorized to work out proposals on making amendments to the Regulations and submit them to the academic council of the University for review, and to the representative council of the University for approval;

g) work out and submit to the rector of THU for approval the mechanisms for ensuring order, fire safety and for providing medical assistance in Tbilisi Humanitarian Teaching University; 

h) exercise other functions provided for by legal acts of the University.

7. The head of the Administration shall be accountable before the representative council, academic council, and the founders’ (partners’) meeting.

8. The grounds for the termination of the term of office of the head of the Administration shall be:

a) reasonable decision of the representative council;

b) reasonable decision of the founders’ (partners’) meeting.

 

Article 13 - Quality assurance service of the University

1. The educational activities of the University (the educational process), also the quality of qualification raising of its personnel is subject to systematic assessment, in which the University students also participate and the results of which are publicly available for all persons interested.

2. For the purposes of the systematic assessment of educational activities, for completing the component of survey, and for the qualification raising of the personnel at the University, a Quality Assurance Service shall be established, which will act in accordance with this Regulations and the Regulations of the Service.

3. The Quality Assurance Service of the University shall closely collaborate with other higher educational institutions for the purposes of establishing transparent criteria for the quality control and the methodology for ensuring such control.

4. The Quality Assurance Service of the University shall ensure high quality of education by way of preparing a system of self-assessment for the implementation of contemporary methods of learning, teaching and assessment (modules, crediting system, etc), and for the process of authorization/accreditation.

5. The head of the Quality Assurance Service of the University shall be appointed by the representative council of the University upon the recommendation of the academic council, with a term of 4 years.

6. The head of the Quality Assurance Service of the University shall be accountable before the representative council, academic council and the rector.

7. The grounds for the termination of the term of office of the head of the Quality Assurance Service of the University shall be a reasonable decision of the representative council of the University.

8. For the purposes of resolving organizational matters of the educational process at the University, and for the purposes of the current management of the educational process at the University, the manager for the administration of the teaching process shall be appointed within the Quality Assurance Service of the University, who shall coordinate the work of the educational process coordinator/coordinators of the faculty;

9. The manager for the administration of the educational process shall be appointed by the rector, upon the recommendation of the head of the Quality Assurance Service of the University; the manager for the administration of the educational process shall be dismissed from the position by the rector of the University.

 

Chapter 3 - Structure of the University

Article 14 - Structure of the University

1. The structure of the University, as well as changes thereto, shall be worked out by the academic council of the University, and shall be approved by the representative council of the University.

2. Description of the structure of the University:

a) the University management bodies and the officials shall be determined by Article 7(2) of this Regulations;

b) there are two services functioning in the University:

- Administrative Service (the Administration); and

- Quality Assurance Service.

c) The Administrative Service integrates a Chancellery, Human Resources, Accounting, International Relations, legal assistance, logistical support, security, archive and doctor’s offices;

d) the main educational and structural unit is a faculty;

e) there are 4 faculties functioning in the University:

- faculty of law;

- faculty of economy, business and management;

- humanitarian faculty;

- faculty of healthcare.

f) there is legal clinic functioning at the faculty of law;

g) there is dentists’ educational clinic functioning at the faculty of healthcare;

h) specialized teachers’ rooms shall be established within the faculty, and their quantity shall be defined by the Regulations of the faculty.

i) the structural unit of the University is the library.

3. The University services, faculties, clinics, and the library shall lead their activities in accordance with this Regulations and the Regulations of their own office.

4. The schematic version of the University shall be attached to this Regulations (Annex 1) and shall be published at the University website.

 

Article 15 - Faculty

1. A faculty is the main educational unit of the University.

2. The representative body of the faculty is the faculty council, which include all academic personnel of the faculty and the students of the program/programs implemented by the faculty, that is 1/4th of the faculty members; the students shall be elected in the faculty council once in 2 years, by the students of the faculty, by way of direct, free and equal elections, secret ballot. The elections shall be organized by the students’ self-government body.

3. The faculty council shall:

a) define and submit to the representative council a financial and budgetary request of the council;

b) elect the dean of the faculty by the majority of members on the list, secret ballot, on the basis of free and equal elections;

c) work out and submit to the academic council of the University for approval education programs implemented at the faculty;

d) approve the strategic action plan for the development of the faculty;

e) work out, upon the recommendation of the dean, the Regulations of the faculty (with the faculty structure) and shall submit for approval to the academic council;

f) be authorized to review the matter with regard to the dismissal from the position of the dean by the request of no less than 1/3 of the members of the faculty council on the grounds of violation of the Georgian legislation by the dean, or improper fulfilment of obligations imposed on the dean and/or on the grounds of the fulfilment of duties that are not designated for the dean. The decision on the early termination of the term of office of the dean shall be made by a secret ballot, by a majority of members on the list. The dean shall not participate in the voting provided for by this paragraph; in the case of the early termination of the term of office of the dean, an acting dean shall be appointed;

g) exercise other powers granted under this Regulations and the Regulations of the faculty.

 

Article 16 - Faculty dean

1. The faculty council shall elect the dean of the faculty for the term of four years. The faculty council of the University shall publish the announcement on the vacancy of a dean for the registration of candidates one month before the start of the registration of candidates, and shall publish the announcement on the elections on the basis of the principles of transparency, equality and fair competition.

2. An elected dean may be a person from the academic personnel of the faculty with a Doctoral Degree or with other scientific degree which is equal to the Doctoral Degree.

3. Faculty dean shall:

a) ensure the effective educational process at the faculty;

b) submit to the faculty council for review the faculty development plan, educational program, and the Regulations of the faculty;

c) within the scope of his/her competence, be responsible for the fulfilment of decisions made by the representative council, academic council, and faculty council;

d) within the scope of his/her competence, issue written resolutions and instructions for the fulfilment of official duties;

e) preside at the meetings of the faculty council;

f) coordinate the work of teachers’ rooms established by the faculty and other structural units of the faculty (laboratory, clinic, cabinet);

g) exercise other powers granted under this Regulations and the Regulations of the faculty.

4. The early termination of the term of office of the faculty dean shall take place in the following cases:

a) on the basis of his/her own application;

b) in the case of the termination of the employment agreement for the academic term of office;

c) in the case of the decease, or if he/she is declared missing, or acknowledged as legally incapable by a court, or in other cases provided for by the legislation.

 

Article 17 - Teachers’ room

1. The teachers’ room shall function on the basis of the Regulations of the faculty, and shall carry out educational and methodological and research activities in accordance with the appropriate specialization.

2. The teacher’s room shall be headed by the professor.

3. The teachers’ room shall:

a) carry out particular measures for the planning of the academic year/semester: define academic hours of the academic personnel, in accordance with the staff status, and the personnel to be invited;

b) gradually listen to the information on the implementation of educational programs, work out proposals for the modification of educational programs;

c) manage the process of the selection of the educational material and of the selection of syllabuses;

d) work out educational and methodological instructions, and coordinate the preparation of lecture courses and their publishing;

e) facilitate the formation of scientific circles of students, and ensure the participation of the students in different exhibitions, conferences and expeditions;

f) facilitate the process of scientific and research activities of the professors and teachers , work out proposals for the qualification raising of professors and teachers, and for their engagement in the academic exchange programs;

g) exercise other authorities defined by the Regulations of the faculty or the faculty council.

 

Article 18 - Laboratory, clinic and/or cabinet 

1. A laboratory, a clinic and a cabinet represent structural educational and/or research units of the faculty, the functioning of which is envisaged by the implemented educational program.

2. Procedures for the functioning of the laboratory, clinic, and the cabinet shall be defined by the Regulations of the faculty, or by the Regulations of the laboratory, clinic and the cabinet, which shall be approved by the council.

 

Chapter 4 - Human resources

Article 19 - Administrative personnel

1. The following personnel shall belong to the administrative personnel of the University:

- the rector, who shall be elected by the academic council;

- the pro-rector, who shall be elected by the rector, within the term of his/her authority;

- the head of the Administration (the Administration Service), who shall be approved by the representative council upon the recommendation of the academic council;

- the head of the Quality Assurance Service, who shall be approved by the representative council upon the recommendation of the academic council;

- the faculty dean, who shall be elected by the faculty council.

2. The appointment of the administrative personnel (except for the rector) of the University shall be carried out on the basis of the order of the rector;

3. The employment agreements shall be signed with the administrative personnel of the University (except for the rector).

4. The employment agreement with the rector of the University shall be concluded by the founders’(partners’) meeting.

5. The administrative officer may simultaneously occupy another administrative position or be the head of another structural unit of the University on the basis of the decision of the rector of the University, although in the exceptional cases.

 

Article 20 - Academic personnel and procedures for their recruiting, and defining the amount and conditions for their remuneration

1. Academic personnel

a) The academic personnel of Tbilisi Humanitarian Teaching University shall comprise the professors, associate professors, assistant professors and assistants;

b) The professors, associate professors and assistant professors shall participate in the educational process and/or scientific research process and/or shall manage such processes;

c) The academic personnel shall carry out seminar and research works during the current academic process under the supervision of the assistant professor, associate professor or assistant professor;

d) The academic personnel shall carry out seminar and research works during the current academic process within the main educational unit under the supervision of the assistant professor, associate professor or assistant professor.

e) The number of the academic personnel of the Teaching University shall be determined on the basis of the staff list.

2. Procedures for occupying academic positions

a) The academic positions may be occupied only on the basis of the open competition, which shall be carried out on the basis of the principles of transparency, equality and fair competition;

b) The positions of the professor and associate professor may be occupied for the term of 8 years;

c) The conditions for the election of the professor for an indefinite term shall be determined by the legislation of Georgia and this Regulations; the professor who is elected to the position for an indefinite term shall undergo compulsory attestation process once in 5 years;

d) the positions of the assistant professor and the assistant may be occupied for the term of 4 years;

e) The decision on the conduction of open competition, including on the determination of the date of the competition and the members of the competition commission shall be made by the academic council;

f) The conditions of the competition shall be determined by the academic council on the basis of the proposals of the faculty, and in accordance with the requirements provided for by legislation of Georgia and this Regulations;

g) The open competition shall be announced on the basis of the order of the rector;

h) The date and the conditions of the competition shall be published no less than 1 month before the receipt of the application and the attached documents, in accordance with the procedures provided for by the legislation of Georgia.

3. Professor

3.1. An academic position of the professor with 8 years of term of office may be occupied by a person who:

a) holds a Doctoral Academic degree or the academic degree which is equal to the Doctoral Academic degree;

b) has no less than 6 years of work experience in science and teaching;

c) has published scientific work for the last 5 years, which verifies his/her competence in the appropriate field;

d) presents in the electronic and print out form a syllabus/syllabuses prepared in the academic discipline which is envisaged by the implemented educational program;

e) completes, together with the application for competition, a typical form, where he/she states that in the case of winning the competition he/she won’t occupy any academic position in educational institutions, which exceed the number of those determined by the legislation of Georgia, in order to deem him/her, for the purposes of accreditation, the academic personnel of Tbilisi Humanitarian Teaching University;

f) meets other requirements of the competition approved by the legislation of Georgia and/or by the academic council of THU.

3.2. An academic position of the professor with an indefinite term may be occupied by a person who:

a) meets the requirements of 3.1. Paragraph of this article;

b) has special professional achievements and/or scientific achievements (for example, has scientific publications in the leading local and international magazines and other publications, has participated in national and international scientific and research projects, etc);

c) agrees to pass compulsory attestation once in 5 years in accordance with the procedures defined by this Regulations.

4. Associated professor

A position of the associated professor may be occupied by a person who:

a) holds a Doctoral Academic degree or the academic degree which is equal to the Doctoral Academic degree;

b) has no less than 3 years of work experience in science and teaching;

c) has published scientific work for the last 5 years, which verifies his/her competence in the appropriate field;

d) presents in the electronic and print out form a syllabus/syllabuses prepared in the academic discipline which is envisaged by the implemented educational program;

e) completes, together with the application for competition, a typical form, where he/she states that in the case of winning the competition he/she won’t occupy any academic position in educational institutions , which exceed those determined by the legislation of Georgia, in order to deem him/her, for the purposes of accreditation, the academic personnel of Tbilisi Humanitarian Teaching University;

f) meets other requirements of the competition approved by the legislation of Georgia and/or by the academic council of THU.

5. Assistant-professor

5.1. A position of the assistant-professor may be occupied by a person who:

holds a Doctoral Academic Degree or the academic degree which is equal to the Doctoral Academic Degree and has no less than 2 years of work experience in science and teaching, and has published scientific work for the last 5 years, which verifies his/her competence in the appropriate field;

b) has appropriate qualification, which is confirmed by the professional qualification, special training and/or publication; a person may be deemed with appropriate qualification who has competence that is required for the working out of educational output envisaged by the program, which shall be verified by the following:

b.a) has 3 years of professional experience and has passed special training, and/or

b.b) has published at least 2 publications during the last 5 years, which verifies the competence in the relevant field, and has no less than 1 year of experience in teaching.

5.2. The assistant-professor shall present in the electronic and print out form a syllabus/syllabuses prepared in the academic discipline which is envisaged by the educational program implemented by the relevant faculty.

5.3. The assistant-professor shall complete, together with the application for competition, a typical form, where he/she states that in the case of winning the competition he/she won’t occupy any academic position in educational institutions , which exceed those determined by the legislation of Georgia, in order to deem him/her, for the purposes of accreditation, the academic personnel of Tbilisi Humanitarian Teaching University;

5.4. The assistant-professor shall meet other requirements of the competition approved by the legislation of Georgia and/or by the academic council of THU.

6. Assistant

A position of the assistant may be occupied by a person who:

a) holds a Doctoral Degree or other academic degree that is equal to the Doctoral Degree, or is a candidate for Doctor, and/or has appropriate qualification, which is confirmed by the professional qualification, special training and/or publication; a person may be deemed a person with appropriate qualification who has competence that is required for the working out of educational output envisaged in the program, which shall be verified by the following:

- has 2 years of professional experience and has passed special training, and/or

- has published a publication during the last 5 years, which verifies the competence in the relevant field.

b) meets other requirements of the competition under the legislation of Georgia and/or approved by the academic council of THU.

7. Procedures for holding an open competition

a) An open competition for the selection of the academic personnel shall be held in accordance with the requirements of the Law of Georgia on Higher Education;

b) A decision on the announcement of the open competition shall be made by the academic council, based on which the rector shall issue an order, where the following will be reflected:

- the date of the announcement of the open competition;

- the number of vacant positions and of the relevant fields;

- qualification requirements submitted to the competitors and the competition documentation to be submitted, including additional qualification requirements for the selection of the professor to the position for an indefinite term, and additional documentation to be submitted, additional qualification requirements of the academic personnel to be selected for the foreign educational programs, and additional documentation to be submitted for the participation in the competition;

- the dates of the start of receiving documentation for competition and the deadline for receiving such documents; the place of the receipt of applications;

- procedures for the publication of the decision of the competition commission;

- the procedures for ensuring the publicity of the competition.

c) on the basis of the decision on the announcement of the open competition , a competition commission shall be established, which shall be completed with professional specialists and the specialists in the relevant fields, the persons with Doctoral Academic Degree, who are not employed by THU on the academic positions occupied by the THU staff; in exclusive cases, a person holding the academic position of the professor at the THU may be a member of the competition commission; the chairman and the secretary of the competition commission shall be elected based on the same decision;

d) the competition commission shall quorate if the meeting is attended by at least more than a half of the total members of the commission;

e) the meeting of the competition commission shall be convened by the chairman of the competition commission;

f) a minutes of the meeting of the competition commission shall be made, which shall be signed by the chairman of the competition commission and the secretary of the meeting;

g) on the first meeting the competition commission shall review the compliance of the received application and the attached documents to the competition conditions and shall find out whether there are grounds to disqualify a participant of the competition; the competition commission shall make a decision on the disqualification of the participant of the competition by the consent of more than a half of the total members of the commission; in the case of equal votes, the vote cast by the chairman of the commission shall be decisive.

h) applications, and the attached syllabuses/scientific works for the competition submitted to the first meeting of the competition commission shall be distributed among the commission members in accordance with the profile, for the purposes of their study and for presenting appropriate opinion;

i) on the second meeting of the competition commission (where necessary - during the additional meeting), the submitted competition applications and opinions on the participants of the competition shall be read and assessed;

j) for the vacancy on the position of a professor and associated professor, each participant shall be assessed by 10 points, from which 4 points shall be given to teaching experience and professional achievements. And 3 points - to scientific achievements, 3 points - to the submitted syllabuses and the methodology of teaching presented therein; for the vacancy of the assistant-professor the participant shall be assessed in the same manner, or on the basis of the analysis of special training and/or publications and scientific or teaching experience - also by 10 points; for the vacant position of the assistant the participant shall be assessed on the basis of the analysis of the academic degree, professional experience and specialized training and/or publication(s), by 10 points;

k) each participant shall be assessed by the members of the commission individually , based on which his/her average rating point will be derived;

l) the candidate/candidates having gained the highest rating point shall be the winner(s) of the competition, but such point shall be no less 5;

m) if an application of 1 participant was submitted for occupying the vacant academic position, he/she shall be declared to be the winner, if the average assessment point is not less than 5;

n) if more than one participant gain equal rating point for one and the same vacancy, the competition commission shall repeatedly assess such participants during the additional meeting; in such case the competition commission shall be authorized to interview the relevant participants; the winner (the participant having the privilege) shall be revealed in accordance with sub-paragraphs j), k), l) and m) of this paragraph;

o) the competition commission shall, with regard to the professors having won the competition, and based on their applications and submitted and reviewed additional competition documents, work out a reasonable opinion on the election of the professor for an indefinite term, which shall be reflected in the relevant minutes of meeting;

p) a decision of the competition commission shall be made by the majority of total members of the commission; in the case of the equal division of votes, the vote cast by the chairman of the commission shall be decisive; the decision of the competition commission shall not be subject to appeal. An order of the rector on the appointment of the academic personnel to the positions shall be subject to appeal in accordance with the procedures determined by the legislation of Georgia.

8. Academic load

The maximum academic load of the professor, assistant professor and assistant shall be determined by the rector of the THU on the basis of the order.

9. Labour relations of the academic personnel and affiliation

9.1. After the selection of the academic personnel on the basis of the open competition, the rector shall issue an order on their appointment to academic positions.

9.2. Labour contracts shall also be concluded with the academic personnel, in accordance with the procedure defined by the legislation of Georgia, for the term of office on the academic position, or with an indefinite term.

9.3. The academic personnel shall be affiliated with the University, if:

a) an “A” category employment agreement is concluded with him/her, and he/she has not concluded any agreement on affiliation, and/or an employment agreement verifying the affiliation with another higher educational institution;

b) he/she shall participate in the processes of the development of the society and the sharing of knowledge, only on his/her own behalf, or on behalf of Tbilisi Humanitarian University;

c) has the minimum academic load at Tbilisi Humanitarian Teaching University, which shall be defined on the basis of the order of the rector; the affiliated academic personnel shall not be imposed the obligation to fulfil relevant minimum academic load, if:

c.a) he/she does not collaborate with any other higher educational institution personnel;

c.b) he/she is simultaneously employed on the administration/assistance (non-academic) position of the University.

9.4. A “B” category employment agreement shall be concluded with the academic personnel who are not affiliated with the University.

9.5. The templates (categories) of employment agreements with the academic personnel shall be approved on the basis of the order of the rector.

10. Amount and conditions for the labour remuneration of the academic personnel

a) The amount of labour remuneration of the person appointed to an academic position, also the conditions for the payment of such remuneration, shall be determined on the basis of the employment agreement between the employer and the employee, individually;

b) The employer and the employee shall be authorized to agree on special conditions for determining the salary (according to the occupied academic position, academic load volume, etc);

c) The employer shall retain the right , on the basis of the individual agreement with the employees, to define different salary for one and the same academic position.

11. Compulsory attestation of the professor elected for an indefinite term

11.1. The aim of the compulsory attestation is to verify special professional and/or scientific achievements (repeated acknowledgement) of the professor elected for an indefinite term.

11.2. The professor elected for an indefinite term shall pass compulsory attestation once in 5 years.

11.3. The compulsory attestation shall be held in the relevant educational unit (faculty).

11.4. The members of the attestation commission and the terms for the conduction of the attestation, upon the recommendation of the relevant dean, shall be approved by the rector of the THU, on the basis of the order; the attestation commission shall be completed by professionals and specialists in this field, the persons holding Doctoral Academic Degree, and it may not involve persons on the academic positions of the relevant faculty; the chairman and the secretary of the attestation commission shall be elected on the basis of the same order;

11.5. The attestation commission shall quorate if the meeting is attended by at least more than a half of the total members of the commission.

11.6. The attestation commission/commissions shall function in accordance with the procedures defined by the competition commission in accordance with this Regulations; a decision shall be taken by the majority of the total members of the commission.

11.7. The professor elected for an indefinite term shall submit to the attestation commission the following documents:

a) scientific work/works published in leading local and international magazines and other editions for the last 5 years;

b) documents verifying the participation in national and international scientific and research projects, with the description of the participation format;

c) manuals/additional manuals/monographs published during the last 5 years;

d) updated syllabus/syllabuses of the educational discipline/disciplines envisaged by the educational program.

11.8. During the compulsory attestation, the Quality Assurance Service shall submit to the attestation commission the latest educational program assessment results, in the implementation of which the relevant person is involved.

11.9. A decision of the attestation commission is based upon the documentation submitted by the professor, as well as on the data about him/her which is kept in the University, the latest results of the educational program assessment, in the implementation of which the relevant professor is involved.

11.10. The following components shall be assessed by the competition commission: professional achievements and scientific achievements.

11.11. Each component shall be assessed based on the assessment of one of the following:

a) good - fully appropriate;

b) satisfactory - partially appropriate;

c) bad - inappropriate.

11.12. The attestation commission shall take the following consolidated decision for each professor:

a) special professional/scientific achievements (with the assessment of Good - in both components) of the professor are fully verified;

b) special professional/scientific achievements (with the assessment of Satisfactory - recommendations of the attestation commission in both components shall be required to be fulfilled) of the professor are partially verified;

c) special professional/scientific achievements of the professor cannot be verified any more (if there is satisfactory assessment in one of the components).

11.13. If based on the decision of the attestation commission it is determined that the person no more complies with the requirements of the occupied position, the rector shall terminate the employment agreement signed with such person based on the order, in accordance with the procedures defined by the legislation of Georgia; the mentioned does not limit the right of the person to:

a) move to the term employment agreement, but for no more than 8 years from the date of his/her election as a professor;

b) occupy a professor’s academic position in THU on the basis of the open competition, on the basis of the term of office.

11.14. The decision under paragraph 11.2(b) of this article may be appealed in a court.

11.15.  The decision under paragraph 11.12(c) of this article shall be appealed together with the rector’s order under paragraph 11.3 of this article.

12. The academic personnel shall have the right to:

a) participate in the management of the higher educational institution in accordance with this Regulations;

b) carry out the teaching without an intervention, as well as creative activities and publish scientific works;

c) within the educational program independently define the content of the educational discipline program (syllabus), and the methods and means of education;

d) exercise other powers determined by the legislation of Georgia.

13. The academic personnel shall be obliged to:

a) obey with the requirements of the acts regulating the educational process in the University;

b) obey with the Internal Regulations of the University and the ethical norms;

c) fulfil the obligations under the employment agreement;

d) submit a report on the works conducted after the qualification raising and/or scientific and creative pause.

14. The University shall ensure:

a) the scientific-research and academic freedom of the academic personnel;

b) the creation of appropriate conditions for activities.

15. Invited (freelance) personnel

a) On the basis of Article 40(6) of the Law of Georgia on Higher Education, on the basis of the recommendation of the appropriate faculty with regard to the educational programs implemented by the same faculty, a specialist with relevant qualification may be invited for the participation in the educational process, without his/her inclusion in the staff list (as a freelancer), on the basis of the employment agreement, and by way of hourly remuneration;

b) The invited freelance personnel shall be - a senior teacher and a teacher;

c) The invited senior teacher shall have a Doctoral Academic Degree or he/she may be other qualified person holding a degree that is equal to the Doctoral Academic Degree, who is a person elected on the higher academic degree of another higher educational institution, or has an appropriate qualification, which is verified by no less than 5 years of professional experience and special training and/or publication;

d) A candidate for a doctor or other qualified person shall be invited as a teacher, who shall be authorized to manage practical and laboratory works and whose qualification shall be verified by no less than 3 years of professional experience and special training and/or publication;

e) On the basis of the relevant recommendation of the relevant faculty, academic personnel of other faculties may also be invited for the educational programs implemented by the same faculty, who shall be on the similar academic position (the invited professor/invited associated professor/invited assistant-professor/invited assistant);

f) A “C” category employment agreement with a term of office shall be signed with the invited personnel, during 1 academic year or a semester.

16. Honourable Doctor

The academic council of THU shall be authorized to confer to the scientist or public figure a title of the Honourable Doctor of Tbilisi Humanitarian Teaching University for special merits.

17. The grounds for the dismissal of the academic and invited (freelance) personnel from the position and for the termination of the employment agreement shall be determined according to the Labour Code of Georgia, the Law of Georgia on Higher Education, and in separate cases, by this Regulations.

 

Article 21 - Assisting personnel

1. The assisting personnel shall be those who are included in the staff list and are necessary for carrying out the University activities.

2. The appointment of the assisting personnel to the positions shall be carried out by the order of the rector; an employment agreement shall be signed with them in accordance with the procedures provided for by the legislation of Georgia.

3. Persons may be employed on the additional positions which are not included in the staff list of the University, depending on the needs of the University, on the basis of the employment agreement.


Chapter 5 -  Students 

Article 22 - Students rights 

1. A student may:

a) obtain quality education;

b) participate in the research;

c) use logistics support, library, information and other means of the University in accordance with the Regulations of the University, its Internal Regulations and other internal legal acts, under equal conditions;

d) on the basis of universal, direct and equal elections, by a secret ballot, elect a representative and be elected in the council of the students’ self-government, faculty council and representative council of the University, in accordance with this Regulations;

e) freely establish and/or be integrated in the students’ organizations, at his/her own initiative;

f) freely express his/her opinion and make a reasonable refusal on sharing those ideas, which are offered during the educational process;

g) move to another educational institution from the second academic year in accordance with the procedure defined by the Statute of the receiving higher educational institution, in accordance with the legislation of Georgia;

h) in accordance with the legislation of Georgia and the internal acts of the University, obtain from the State, University or other sources a stipend or other type of advantage;

i) select an educational program;

j) participate in the working out of individual and educational program;

k) periodically make assessment of the academic personnel;

l) exercise other powers granted under the legislation of Georgia.

2. The University shall establish the conditions that are required for the students with disabilities in order to provide them with complete education, as provided for by the legislation of Georgia; the students with disabilities shall be ensured by a free movement in the University; in the cases where it is impossible for the student to move in any part of the University, the University shall be obliged to provide a student with disabilities with an educational inventory placed in this particular section of the University building, where he/she may easily move; in the cases where the student with disabilities Is not able move to the cabinet of the University personnel, such personnel shall be obliged to receive the  student with disabilities at the section which is favourable for the student.

3. The personal information expressed by the student in witness of the academic personnel, also information on own ideas, belief and political belief, which has become known for the latter during the educational process, as well as information with regard to disciplinary measures against the student shall be confidential, except for the cases where there is students’ permit thereto, or it is in the legal interests of the University to protect the safety of others and the rights protected by law. Information on the academic assessment of the student and on disciplinary measures against him/her shall be kept separately.

4. The University shall be prohibited to use its powers and logistical base in the manner that may pose threat of censure, or limit the freedom of expression, except for the case, where the student’s behaviour contravenes the ethical norms of those students who ensure the educational procedure;

5. The University shall ensure the fair assessment of the students’ knowledge, for which it shall work out appropriate procedures.

6. The disciplinary persecution of a student shall be proportional to the disciplinary misconduct of the student and may be carried out only in the cases provided for by the Internal Regulations of the University, on the basis of fair procedures. The University shall work out the student’s ethical norms, which may regulate the limitation of the student’s behaviour, if it is related to the conduct of the education process.  The University shall be obliged to define the code of conduct in details, which causes disciplinary liability.

7. The student having completed all the tasks envisaged by the educational program and who has obtained relevant credits under the educational program, shall be granted appropriate academic degree or appropriate qualification and shall be given the diploma according to the form determined by the State.

 

Article 23 - Student’s obligations

1. A student shall be obliged, in accordance with the educational program implemented by the University, learn all those subjects, the teaching of which are compulsory, as well as those subjects, which have been chosen on the basis of his/her own will.

2. Obey with the Regulations of the University and the Internal Regulations.

3. Complete internal acts of the University related to the educational process, including the decisions of the academic and representative councils, and the rector’s order.

4. Completely fulfil the duties under the agreement signed with the University on the educational activities.

5. Rules and conditions for the suspension and termination of the students’ status shall be determined in accordance with the procedures for obtaining, suspending and terminating a student’s status approved by the academic council, also in accordance with the conditions for the recognition of education received during the educational period.

 

 Article 24 - Rights of students’ self-government 

1. A students’ self-government body shall be created on the basis of the faculties, by secret ballot, universal, equal and direct elections.

2. The self-government body of the University shall work out the Regulations of the students’ self-government.

3. In accordance with its regulations, the students’ self-government body shall:

a) ensure the participation of students in the management of the University, by way of participation in the representative council;

b) ensure the protection of students’ rights;

c) ensure the election of students’ representative bodies in the faculty councils;

d) be authorized to work out proposals for the improvement of faculty or University management, and for the purposes of the improvement of the teaching quality, which shall be submitted to the faculty council and the representative council;

e) exercise any other powers provided for by the Regulations of the students’ self-government body.

4. The University management bodies shall have no right to interfere in the activities of the students’ self-government body.

 

Chapter 6 - Educational programmes

Article 25 - Academic higher educational programmes 

1. The University shall carry out the following academic higher educational programmes:

a) bachelor’ s educational programmes (the first level); Bachelor’s Educational Programmes in the case of gaining no less than 240 credits the student shall be granted the bachelor’s academic degree; persons holding a certificate of the secondary education or the document which is equal to the one mentioned in the previous sentence, shall have the right to study on Bachelor’s Educational Programmes; the aim of the study for Bachelor’s academic degree shall be, together with undergoing professional training, which is higher than the secondary education, gaining the deeper knowledge of theoretical aspects of educational disciplines, which will ensure the training of a person using the programs having investigative nature, to ensure his/her enrolment in the Master’s program and his/her further employment in accordance with the limitations provided for by the legislation of Georgia.

b) a one level higher educational program for certified dentists, under Article 471 of the Law of Georgia on Higher Education (which is equal to the second level); A one level higher educational program for the certified dentists, in the case of gaining 300 credits, the student shall be conferred the academic degree of a certified dentist;

c) Master’s Educational Programmes (the second level); in the case of gaining no less than 120 credits on the basis of a Master’s Educational Program, the student shall be conferred a Master’s academic degree; a bachelor or a person with an equal academic status may study on the Master’s academic program; the aim of the study on the Master’s program is to train for scientific and research work and for the teacher’s practice in a higher educational institution; the change of speciality (except for regulated educational programs); qualification raising; the Master’s Educational Program envisages the independent conduct of research by a student, based on which he/she will be able to submit work for gaining qualification.

2. During one academic year the educational program involves, as a rule, 60 credits;

3. After overcoming each educational level, an appropriate diploma, with a standard annex, shall be issued.

4. The person who has not or was not able to complete appropriate educational level, shall be given the relevant certificate.

 

Article 26 - Other educational programmes 

1. The University shall be authorized, except for academic higher educational programs defined by this Regulations, to carry out professional educational programs in accordance with the Law of Georgia on Vocational Education.

2. Vocational Educational Programs at the University shall be carried out on the basis of the Regulations on Vocational Education, which shall be approved by the academic council;

3. The University shall be authorized to carry out other educational programs, except for the Doctoral Educational Program, in accordance with the legislation of Georgia.

 

Article 27 - Language of teaching 

The language for the implementation of the educational programs of the University shall be Georgian, and also a foreign language, in the case of obtaining appropriate permit thereto in accordance with the procedures provided for by the legislation of Georgia.



Chapter 7 - Grounds for the enrolment of a student in the University

Article 28 - General procedures for the enrolment of students on Bachelor’s and Certified Dentist’s one level educational programs

1. The enrolment of entrants on Bachelor’s and Certified dentist’s one level educational programs shall be carried out on the basis of centralized university entrance examinations, in accordance with the procedures provided for by the legislation of Georgia, in accordance with the list published by National Assessment and Examinations Centre, except for exclusions provided for by the Law of Georgia on Higher Education. 

2. For the purposes of the facilitation of entrants and the mobility of students, the education in the University without passing centralized examinations in accordance with the procedures provided for by the Ministry of Education and Science of Georgia and within the time limits determined by the latter shall be permitted only in the cases provided for by the law of Georgia on Higher Education.

 

Article 29 - General procedures for recruiting entrants on the Master’s Educational Programs

1. For the purposes of enrolling students on the Master’s Educational Program, the University shall be integrated within the unified Master’s examination network.

2. Only those candidates for master’s degree may participate in the exam/exams for enrolling students on the Master’s educational programs, who have succeeded in unified master’s examinations as provided for by the legislation of Georgia and who have overcome the minimum competence limit as provided for by the legislation of Georgia.

3. For the purposes of the facilitation of entrants to the Master’s program and the mobility of students, the education in the University without passing centralized examinations in accordance with the procedures provided for by the Ministry of Education and Science of Georgia and within the time limits determined by the latter shall be permitted only in the cases provided for by the law of Georgia on Higher Education. In this case, the right to study at the Master’s Educational program shall be obtained only in accordance with the procedure provided for by the Law of Georgia on Higher Education, by overcoming the minimum competence limit as provided for by the legislation of Georgia for the enrolment of students on the Master’s Education Program.

Article 30 - Procedures for the reorganisation and liquidation of the University

Reorganization and liquidation of the University shall be carried out in accordance with the Statute of the University, on the basis of the decision of the founders’ (partners’) meeting of the University, and in accordance with the procedures provided for by the legislation of Georgia.
